Oyugis Magistrate Court Nullifies Vickins Bondo Victory

The Oyugis Magistrate court has nullified the victory of the Member of County Assembly (MCA) for West Kasipul, Vickins Bondo.

Peter Ongili, an ODM candidate, filed the petition on August 30 last year to challenge the victory of Bondo who stood as an Independent candidate in last year’s general election citing irregularities on election day.

Bondo was declared winner in the August 9 elections after garnering 4041 votes against Ongiri’s 3975 votes.

In his judgment, Senior Principal Magistrate Benard Omwansa said that the court was not satisfied that the 2nd respondent (Bondo) was duly elected as the MCA adding the court was unable to verify that the election was administered in an impartial, neutral, efficient, accurate, and accountable manner.

The court said that 78 ballot papers could not be accounted for through the counterfoil indicating that they were used during elections.

He said that though the discrepancies appear to be small, cumulatively they cause a huge impact during closely contested elections.

The Court ordered IEBC to conduct fresh elections by law.
