Presidential Petition Pre-trial Conference Set For Tuesday

A presidential petition challenging Kenya Kwanza’s presidential aspirant William Ruto’s victory as president-elect is set to take off on Tuesday at 11:00 am.

“Take notice that the pre-trial conference has been scheduled for 30th August 2022, at the Milimani Law Courts ceremonial hall at 1100hrs,” a notice from the judiciary stated.

A bench of seven supreme court judges will hear the nine petitions filed, eight of which are seeking to challenge Dp Ruto’s win.

On Monday, Ann Amadi, Chief Registrar of Judiciary revealed that only four lawyers from each party would be allowed in the pre-trial and hearing of the presidential petition.

Other parties who will be allowed include; petitioners, respondents,  interested parties, and eleven observers including a regional trial observation mission consisting of a High-Level panel of eminent African jurists who are members of the Africa judges and jurists Forum.

Meanwhile, the supreme court has kicked out a petition seeking the removal of the Attorney General and the four Independent Electoral and Boundaries commissioners on the presidential petition.

At the same time, the court denied William Ruto’s request that the Law Society of Kenya (LSK) be excluded from the trial.

The court says one of the petitioners, Martha Karua is an LSK member and former leader, and therefore, the body cannot be neutral in the matter.

Deputy President Ruto was declared the winner of the August 9 general election after he met the constitutional requirements of ‘50 percent plus one vote to avoid a runoff.
