The passing of the Persons with Disabilities Act, 2025, marked a monumental victory for inclusive education in the country.

This Act lays out a clear roadmap for ensuring that no child’s education is overlooked and that every individual with a disability has the opportunity to learn, grow, and thrive alongside their peers.

The Act stands as a comprehensive promise, embedding the principle of inclusive education deeply within the country's legal and social framework. It is a decisive move away from outdated models of segregation and towards a future where schools are truly open to all.

The law mandates the integration of learners with disabilities into mainstream schools, guaranteeing free and compulsory basic education for all.

This is backed by a commitment to affirmative action in enrollment at every level, from primary school to university, ensuring that educational institutions actively work to welcome and support students with disabilities.

The Act recognizes that inclusive education requires more than just a policy; it requires resources and skilled professionals. It specifically mandates the allocation of resources for disability training, a crucial step that will empower teachers with the knowledge and skills needed to effectively teach in an inclusive classroom.

This commitment to professional development is essential for creating a learning environment where every student, regardless of their needs, can succeed.

The new law extends its reach to the earliest stages of learning, obligating counties to ensure free and compulsory pre-primary education for children with disabilities.

This early intervention is vital for a child's development and sets them on a path to a lifetime of learning.

The Act also guarantees equality and non-discrimination in all education-related opportunities and benefits, dismantling systemic barriers that have long prevented persons with disabilities from accessing the full benefits of a quality education.

At its core, the Act is about protecting the rights of the child. It explicitly guarantees the rights of children with disabilities, including their access to inclusive education, family life, expression, and protection from harm.

By making the best interest of the child paramount, the law ensures that all decisions related to a child's education are made with their well-being and development as the top priority.

With the enactment of the Persons with Disabilities Act, 2025, inclusion in Kenya is no longer a choice; it is a legal and moral obligation.
