Pre-trial Hearing For Kitutu Chache Constituency Petition

Litigants challenging the Kitutu Chache South MP Anthony Kibagendi poll’s victory have filed eight grounds points to petition a court in Kisii, challenging the court to invalidate the win. 

Geoffrey Getuba and Nathan Mosima, argue in their petition that the August poll in which Kibagendi was declared Victor was marred with massive irregularities. 

Through lawyer Shadrack Wamboi, the petitioners want the court to determine if the poll was free, fair, verifiable, and by the constitution. 

Among other issues, they want the court to carry legal audit on the alterations of results contained in forms 35 As. 

Ratemo Ombui, the advocate representing the 1st respondent (Antony Kibagendi), addressing journalists after the pre-trial hearing said they were given directions on how the petition will be conducted and basics on how to behave towards each other.

Justice Mugure Thande who is the judge for the case directed that the hearing of the petition will commence on 14th, November 2022 when the petitioners will present their witnesses while the 2rd and 3rd respondents will be heard beginning 21st November 2022 whereas the 1st respondent will be on the following week.
