The High Court has declined to lift injunctions blocking the payment of over Sh6 billion linked to the National Youth Service (NYS) “air supply” scandal. The orders, initially granted to halt disbursement of funds allegedly linked to fictitious contracts and forged procurement documents, have been extended until January 15, 2026, pending further hearings.
The Ethics and Anti-Corruption Commission (EACC) had moved to court to prevent the NYS from releasing the disputed funds, arguing that the payments were irregular and could not proceed until investigations and legal proceedings were complete. The court maintained the restraining orders to safeguard public funds while the allegations are thoroughly examined.
Affected supplier companies, including firms associated with businessman Benson Gethi Wangui, have filed applications seeking to set aside the orders and compel the EACC to release original payment vouchers and Local Purchase Orders (LPOs) in its custody. They argue that withholding the documents has unfairly prevented them from claiming legitimate dues.
The ruling directs the EACC to release the payment vouchers and supporting documents to the claimants by the close of business, while continuing to block actual payments. Authorities say the decision balances transparency and accountability, allowing suppliers access to records while protecting public funds as investigations into the NYS scandal continue.
