Babu Owino’s Acquittal in DJ Evolve Shooting Case

Babu Owino has been cleared of charges as the prosecution was unable to substantiate his involvement in the shooting of DJ Evolve, whose real name is Felix Orinda. The Member of Parliament for Embakasi East had been accused of firing at DJ Evolve within B Club. Babu Owino vehemently denied the allegations, asserting that he did not have possession of a firearm on the specified day in 2020.

Nevertheless, Babu Owino did acknowledge that he covered DJ Evolve’s extensive medical expenses, as DJ Evolve had sustained severe injuries that have left him incapacitated till now. Senior Principal Magistrate Bernard Ochoi, presiding over the case, acquitted Babu Owino based on the insufficiency of evidence presented by the prosecution to directly link the MP to the shooting.

The widely circulated CCTV footage shortly after the incident was dismissed as evidence by the magistrate. The prosecution’s shortcomings were noted, including their failure to obtain a statement from the victim and the limited nature of the ballistic evidence introduced during the trial. Consequently, this evidence could not be considered reliable enough to establish Babu Owino’s guilt.

The magistrate emphasized that the prosecution was unable to persuade the court that Babu Owino was responsible for the shooting. Additionally, the prosecution omitted medical reports pertaining to samples and tests collected at the scene on April 17, 2020, when the incident took place. Notably, the ballistic experts even admitted in their testimony that the bullet and cartridge recovered from the scene did not correspond.
