President William Ruto has appointed Court of Appeal Judge Justice Mohamed Abdullahi Warsame as a Judge of the Supreme Court of Kenya, marking a key addition to the country’s apex court. The appointment was formalised through a Gazette notice dated May 5, 2026.
Justice Warsame’s elevation was made under Article 166(1)(b) of the Constitution, which empowers the President to appoint Supreme Court judges based on recommendations from the Judicial Service Commission (JSC). The JSC had earlier forwarded his name following competitive interviews held on April 29, 2026.
The selection process placed Justice Warsame among the top-ranked candidates after a rigorous vetting exercise that assessed legal competence, integrity, and judicial experience. His appointment comes after a vacancy created by the death of Supreme Court Judge Mohammed Ibrahim in 2025.
Before joining the Supreme Court, Justice Warsame served at the Court of Appeal from 2012, where he handled major appellate cases involving constitutional interpretation, commercial disputes, and public law matters. His earlier judicial career began at the High Court in 2003.
During his tenure at the High Court, he presided over a wide range of cases, including commercial litigation, judicial review applications, and criminal appeals. He earned recognition for his detailed legal reasoning and emphasis on procedural accuracy.
Legal analysts have often described him as a judge who leans toward strict statutory interpretation, with a preference for judicial restraint rather than expansive constitutional readings. His rulings are widely viewed as methodical and grounded in legal text.
The appointment is expected to strengthen the Supreme Court’s capacity as Kenya’s highest judicial authority, particularly in handling election petitions, constitutional disputes, and cases of national importance.
With his inclusion, the Supreme Court is now fully constituted, comprising Chief Justice Martha Koome, Deputy Chief Justice Philomena Mwilu, and Justices Smokin Wanjala, Isaac Lenaola, William Ouko, Njoki Ndung’u, and Mohamed Warsame.
