High Court Rejects Jackson Kihara Bid To Review 20 Year Robbery Sentence

The High Court has dismissed an application by Jackson Kihara seeking a review of his 20-year prison sentence for robbery with violence, ruling that the request lacked merit and raising no sufficient legal basis to disturb earlier findings.
Court records show that Kihara, who is serving the sentence following his conviction in 2019, argued that the punishment was excessive and that his case warranted reconsideration. He also maintained that he was wrongfully convicted in connection with the incident.
The court, however, noted that his conviction and sentence had already been examined through the appellate process, where earlier rulings upheld the findings of the trial court in full.
Judges found no new evidence or exceptional circumstances that would justify reopening the case or altering the sentence, emphasizing that the legal threshold for review had not been met.
Kihara, who is linked in public records as the son of the late Nyeri Governor Nderitu Gachagua, has previously made multiple attempts to challenge both his conviction and sentencing.
The original case involved charges of robbery with violence tied to the theft of a motor vehicle along Lang’ata Road in Nairobi, where the court found that violence was used during the incident.
The High Court reiterated that the prosecution had sufficiently proved all elements of the offence beyond reasonable doubt, including identification and participation in the robbery.
In its final determination on the review application, the court concluded that there was no error in law or procedure that would warrant interference with the 20-year custodial term, effectively maintaining the status quo of the earlier judgment.
