The High Court of Kenya has temporarily blocked the planned demolition of Gikomba market and the eviction of over 3,000 traders and residents along the Nairobi River. The order, issued on March 4, 2026, directs authorities to maintain the status quo until a full hearing scheduled for March 10, 2026.

The interim ruling followed a petition filed by traders and residents, represented by lawyer Babu Owino, who argued that the 14-day demolition notice issued in February was procedurally unfair and threatened permanent homes, businesses, and community facilities.

Petitioners claim they are lawful allottees with valid titles and have paid all statutory dues, giving them constitutionally protected property rights. They further argue that enforcing a 30-metre riparian reserve without detailed surveys or consultation is arbitrary.

The court noted that the demolitions could violate rights to property, human dignity, adequate housing, and fair administrative action under the Constitution. Petitioners requested temporary conservatory orders to prevent any interference with the affected properties.

Areas covered by the interim order include Blue Estate, Bahati Annex, Kamukunji, Gikomba Open Air Market, and Gikomba Cloth Market, where traders and residents operate and live.

Respondents in the case include the Nairobi County Government, the Water Resources Authority, and the Attorney General, who have been ordered to respond to the petition within two days of service.

Justice Lilian Kimani certified the matter as urgent, ensuring that no demolitions or evictions take place before the scheduled full hearing.

The interim ruling provides relief to traders and residents, allowing them to continue their businesses and livelihoods while the legal process unfolds.

A full hearing on the matter is set for March 10, 2026, when the court will determine whether the planned demolitions and evictions can proceed.
