HiFormer Kiambu Governor Ferdinand Waititu has been released from prison after the High Court reviewed his bail terms as he awaits the hearing and determination of his appeal in the Sh588 million Kiambu roads graft case. The court allowed his release pending the outcome of the appeal.
Waititu had been serving a jail term following his conviction in a corruption case linked to the irregular award of a road construction tender during his tenure as Kiambu governor. The tender, valued at about Sh588 million, was awarded to a company associated with his family.
The trial court had earlier found him guilty of corruption and conflict-of-interest charges connected to the tender. The ruling stated that he benefited indirectly from the contract through entities linked to him.
Following the conviction, Waititu was sentenced to either pay a fine of about Sh53.5 million or serve a 12-year prison term. He was subsequently committed to prison after failing to immediately meet the financial penalty.
The case also involved other accused persons, including his wife and several officials who were charged in connection with the procurement process. The court found that the tendering process had been manipulated to favor a specific contractor.
Investigations into the case were conducted by the Ethics and Anti-Corruption Commission, which alleged that public funds were misused during the implementation of the road project in Kiambu County.
Waititu later filed an appeal challenging both the conviction and the sentence, arguing that the trial court erred in its findings and interpretation of the evidence presented.
The High Court decision to review his bail terms now allows him to remain out of custody while the appeal process continues. The court set conditions aimed at ensuring his availability during the hearing of the case.
The outcome of the appeal is expected to determine whether the conviction and sentence against the former governor will be upheld or overturned.
