Court Orders DPP Ingonga To Engage EACC Over Obado’s Sh505 Million Graft Plea Deal

The Anti-Corruption Court has directed Director of Public Prosecutions (DPP) Renson Ingonga to hold consultations with the Ethics and Anti-Corruption Commission (EACC) within 14 days over a disputed plea bargain seeking to withdraw graft charges against former Migori Governor Okoth Obado. The matter, which involves the alleged misappropriation of Sh505 million in county funds, will be mentioned again on November 7, 2025.
The directive follows a heated courtroom exchange in which EACC opposed the withdrawal of charges, insisting that it had not signed off on the proposed plea agreement between the Office of the Director of Public Prosecutions (ODPP) and Obado’s legal team. The DPP, however, argued that plea bargains fall within his constitutional mandate and can be used to settle corruption cases in line with the Criminal Procedure Code.
Reports indicate that under the proposed deal, Obado and his co-accused agreed to forfeit assets worth approximately Sh235 million to the State as part of a broader recovery process. EACC, however, maintains that it was not adequately consulted and has called for transparency and accountability in the negotiation process.
The case dates back to Obado’s tenure as Migori Governor between 2013 and 2017, during which he and several associates were accused of embezzling public funds through fictitious contracts and companies linked to his family members. The former governor has consistently denied any wrongdoing.
As the November mention approaches, all eyes are on whether the DPP and EACC will reach a consensus, potentially paving the way for a negotiated settlement—or whether the high-profile corruption case will proceed to a full trial.
