Court Grants Raphael Tuju Temporary Relief In Property Auction Dispute

Former Jubilee Party Secretary General Raphael Tuju has secured temporary relief after the Commercial Court allowed him to challenge a ruling that had cleared the way for the auction of his properties.

The court issued interim orders granting Tuju and his company, Dari Limited, leave to appeal a March decision that permitted auctioneers to proceed with the sale of the assets.

The directive effectively pauses immediate enforcement actions, including the auction or transfer of the contested properties, pending a full hearing.

The dispute centres on a multi-billion shilling loan owed to the East African Development Bank, which financed property developments in Nairobi’s Karen area.

Tuju’s properties, including high-value hospitality and commercial developments, were used as collateral for the loan, which has grown significantly due to accrued interest and legal costs.

Earlier, the High Court had dismissed Tuju’s application seeking to block the auction, ruling that the matter had already been determined in previous proceedings.

That decision had effectively lifted earlier protections, allowing auctioneers and valuers appointed by the lender to move forward with recovery efforts.

However, the latest court orders now provide a short-term safeguard, ensuring that no irreversible action is taken before the appeal is heard.

The case is scheduled for a full hearing on April 7, where the court is expected to determine whether the auction process can proceed.
