Court Bars EACC From Arresting Kiambu Governor

The High Court of Kenya has extended orders blocking the arrest or prosecution of Kimani Wamatangi over graft allegations until March 31, 2026. The ruling maintains the status quo while the court considers legal challenges filed by the governor.
The orders prevent the Ethics and Anti-Corruption Commission and the Director of Public Prosecutions from taking any action to detain or charge Wamatangi in connection with ongoing investigations into alleged corruption involving the Kiambu County government.
The move follows a petition by Wamatangi seeking to restrain anti-graft agencies from pursuing him while legal questions over the investigation remain unresolved. The High Court also transferred the matter to the Anti-Corruption and Economic Crimes Division for further handling.
The allegations relate to a civil asset recovery suit in which the EACC is seeking to recover an alleged Sh813 million linked to abuse of office, unlawful procurement and conflicts of interest. The suit also includes orders freezing bank accounts connected to companies associated with Wamatangi.
Wamatangi has consistently denied any wrongdoing, and his legal team has argued that the investigations amount to harassment and breach his constitutional rights. They have sought judicial protection while the case is pending.
The court’s extension does not absolve Wamatangi of the underlying allegations. Instead, it ensures that the governor cannot be arrested or prosecuted until the legal issues are addressed by the judiciary.
Further proceedings will include filing of additional submissions, clarifications on jurisdiction, and consolidation of related matters before the anti-graft division. The court will revisit the orders at the end of March.
The case highlights ongoing tensions between high-profile elected officials and anti-graft agencies in Kenya, underscoring the role of the judiciary in balancing investigative powers with constitutional protections.
