KRA Suspends Nil Tax Filings Until End of March to Expand Tax Base

The Kenya Revenue Authority (KRA) has temporarily blocked all nil tax filings until the end of March, Deputy Commissioner Patience Njau confirmed on Tuesday. The suspension affects individuals and businesses submitting returns showing no taxable income for the 2025 year of assessment.
Njau explained that the move is designed to give KRA time to review and cross-check data from multiple sources before allowing nil returns to be submitted. The authority aims to ensure that all taxpayers accurately report income and reduce instances of underreporting.
“The suspension is part of our wider strategy to expand the tax base and bring more non-filers and nil filers into the tax net,” Njau said. She noted that KRA will use records such as withholding taxes, employment income, eTIMS invoices, financial transmission data, and customs records to generate pre-populated returns for verification.
Taxpayers affected by the temporary halt will not face penalties during this period, KRA assured. The authority emphasized that the suspension is procedural and intended to improve the accuracy and completeness of tax filings.
Data from KRA shows that only about four million out of the eight million taxpayers who filed returns in recent years actually paid taxes. This highlights a significant gap in compliance and underscores the need for measures to identify hidden or misreported income.
The authority also stressed that all Kenyans with a KRA PIN are legally required to file annual tax returns, including nil returns if no income is earned. The temporary block does not exempt taxpayers from this legal obligation but pauses submissions until KRA completes its data review.
KRA’s initiative reflects a growing trend by the authority to validate income and expenses reported on returns against internal data sources. The measure aligns with ongoing efforts to strengthen enforcement and ensure fairness in the tax system.
Deputy Commissioner Njau encouraged taxpayers to await further guidance before attempting to file returns, assuring that nil filing functionality will be restored once the review is complete and discrepancies resolved. The authority reiterated its commitment to expanding compliance while safeguarding taxpayer rights.
