The Judicial Service Commission (JSC) has nominated Justice Mohammed Warsame for appointment as a Judge of the Supreme Court of Kenya
The Judicial Service Commission has nominated Mohamed Abdullahi Warsame for appointment to the Supreme Court of Kenya, marking a significant step in filling a vacancy at the country’s highest judicial organ. The decision was announced after the commission concluded a competitive recruitment process, positioning Justice Warsame as the preferred candidate pending formal appointment.
The nomination followed a rigorous two-day interview process conducted by the commission, during which shortlisted candidates were subjected to public vetting. The interviews assessed professional competence, judicial temperament, integrity, and adherence to constitutional values, in line with the commission’s mandate to ensure merit-based appointments to the bench.
Justice Warsame currently serves at the Court of Appeal of Kenya, where he has been a judge since 2012. Over the years, he has built a reputation for handling complex legal disputes and contributing to the development of jurisprudence, factors that weighed in his favor during the selection process.
The vacancy in the apex court arose following the death of Mohamed Ibrahim in late 2025, shortly before his anticipated retirement. His passing created an opening that the commission moved to fill earlier this year through a nationwide call for applications, attracting several qualified candidates from within the judiciary and legal profession.
Following the nomination, the commission has forwarded Justice Warsame’s name to William Ruto for formal appointment as required under Article 166 of the Constitution. The President is expected to review the recommendation and, if satisfied, proceed to officially appoint and gazette him as a judge of the Supreme Court.
If appointed, Justice Warsame will join a bench tasked with determining some of the most critical legal and constitutional questions in the country, including presidential election petitions and disputes involving interpretation of the Constitution. His experience at the appellate level is expected to bolster the court’s capacity in handling complex litigation.
The development underscores ongoing efforts by the Judicial Service Commission to strengthen the judiciary through transparent and competitive recruitment processes. Observers note that the appointment, once finalized, will restore the Supreme Court to full strength and enhance its ability to discharge its constitutional mandate efficiently.
