High Court Halts Sh207 Billion Kenya–US Health Deal After Omtatah Petition

The High Court has suspended the implementation of the entire Sh207 billion Kenya–United States health cooperation agreement, citing legitimate constitutional and legal concerns that must first be addressed. The conservatory orders were issued pending the hearing and determination of a petition filed by Busia Senator Okiya Omtatah.
In its ruling, the court directed the government and all its agencies to refrain from implementing, operationalising, or giving effect to any aspect of the agreement. The judge noted that the issues raised in the petition were substantial and warranted judicial scrutiny before the deal could proceed.
Senator Omtatah challenged the agreement on grounds that it was entered into without sufficient public participation or parliamentary approval. He also raised concerns over sovereignty, fiscal obligations, and the potential exposure of sensitive personal health data belonging to Kenyan citizens.
The court observed that the concerns raised touched on constitutional safeguards, including transparency, accountability, and data protection. It held that allowing the deal to proceed before resolving these issues could result in irreversible consequences.
The government has indicated it will comply with the court order as it prepares its response. The case is expected to shape future engagements involving large-scale international agreements, particularly those affecting public funds and sensitive national data.
