EACC Files Suit to Recover Sh330.5 Million from Ex-Sports PS and FKF President

The Ethics and Anti-Corruption Commission (EACC) has filed a High Court suit seeking to recover Sh330,573,997 allegedly lost through irregular contracts linked to the 2018 African Nations Championship (CHAN).
The civil case, filed on January 22, 2026, targets former Sports Principal Secretary Peter Kirimi Kaberia and ex-Football Kenya Federation (FKF) President Nick Mwendwa, along with senior ministry officials and directors of private firms involved in the procurement.
The suit alleges that the funds were misappropriated through a single-sourced, non-competitive stadium security and systems contract, awarded in 2017, in violation of public procurement laws.
Investigators say the contract received an advance payment of Sh1.5 billion, but no security, access control, communications, or pitch lighting systems were installed in the CHAN stadiums.
The Sh330.57 million that forms the basis of the suit was allegedly transferred to Auditel Kenya, despite no work being delivered under the contract.
The EACC alleges that portions of the money were further transferred to local companies and individuals linked to the procurement process, raising suspicions of money laundering and graft.
In addition to the civil suit, the commission has recommended criminal investigations into the officials named in the case for abuse of office and violations of procurement laws.
The EACC has forwarded its investigative findings to the Office of the Director of Public Prosecutions (ODPP) for possible criminal action against the implicated officials.
Lawyers representing the ex-Sports PS and FKF President have not yet filed formal responses, and court proceedings are expected to commence in the coming weeks.
The commission emphasized that the suit seeks to recover public funds and serve as a deterrent against irregularities in government contracts.
The case has drawn attention to lapses in the management of funds for national sporting events, with critics calling for stronger oversight of public procurement processes.
EACC officials said the commission will continue pursuing all avenues to reclaim public money and hold accountable those responsible for the misappropriation in the 2018 CHAN preparations.
