EACC Arrests Nyamira Assembly Clerk Over Sh30.2 Million Tender Fraud

The Ethics and Anti-Corruption Commission (EACC) has arrested Nyamira County Assembly Clerk Duke Simeon Onyari over allegations of procurement irregularities linked to the construction of the county assembly office block, a project investigators say resulted in the loss of Sh30.2 million in public funds.
According to investigators, the case revolves around the award of a multimillion-shilling construction tender in 2018. EACC alleges that procurement laws and procedures were ignored during the tendering process, leading to the unlawful award of the contract and financial loss to taxpayers.
The anti-graft agency claims that the contract was awarded to Jetta Builders Limited despite the company not emerging as the lowest evaluated bidder. Investigators contend that the decision gave the contractor an undue financial advantage amounting to approximately Sh30.2 million.
Onyari is among a group of current and former county assembly officials who have been linked to the controversial project. The probe has also focused on members of the procurement and tender evaluation committees who participated in the award process.
Prosecutors are pursuing several charges against the suspects, including abuse of office, failure to comply with public finance and procurement laws, and neglect of official duty. Authorities argue that established procurement regulations were disregarded during the implementation of the project.
The investigation into the office block project has been ongoing for several years, with detectives examining procurement records, tender documents and financial transactions related to the contract. The matter has emerged as one of the most significant corruption cases involving the Nyamira County Assembly.
Court proceedings in the case have already seen some suspects seek anticipatory bail in an effort to prevent their arrest. However, the courts declined the applications, paving the way for the arrests and prosecution of those implicated in the alleged scheme.
The arrest of the assembly clerk marks the latest step in EACC's campaign against corruption in county governments. The commission has maintained that it will continue pursuing individuals suspected of misappropriating public resources while seeking the recovery of any funds lost through irregular procurement processes.
