Health Cabinet Secretary Aden Duale has shared his views on the proposal by Prime Cabinet Secretary and Foreign Affairs CS Musalia Mudavadi to hold a constitutional referendum alongside the 2027 General Elections. Duale noted that calls for constitutional changes are not new in Kenya’s political discourse.

Speaking on the matter, Duale said the Constitution clearly outlines procedures for addressing national questions and governance challenges. He emphasised that whenever uncertainties arise, the courts provide guidance, cautioning against approaches that fall outside established legal frameworks.

Duale argued that not every political or governance issue warrants a referendum, stressing that such decisions must be guided by constitutional provisions, particularly those that specify matters eligible for a public vote. He said adherence to the rule of law is essential to avoid setting risky precedents.

On issues such as electoral boundary delimitation, which Mudavadi has cited as a concern, Duale pointed out that the matter is already addressed within the Constitution. He noted that delays in previous processes were largely due to institutional challenges, including the lack of a fully constituted Independent Electoral and Boundaries Commission (IEBC) at the time.

The Health CS further stated that other concerns often linked to referendum debates, including governance and representation matters, are currently being handled through parliamentary and legal processes. He warned that rushing into a referendum could undermine these ongoing constitutional mechanisms.

Mudavadi has argued that a referendum could help resolve outstanding constitutional questions before the 2027 polls. However, Duale’s remarks reflect a contrasting position, underscoring that Kenya’s Constitution already provides clear pathways for resolving disputes without necessarily resorting to a nationwide vote.
