Court's Ruling on CASs Apointees Receive Mixed Reactions
The decision by the High Court to quash the appointment of 50 chief administrative secretaries by President William Ruto has elicited mixed reactions from political leaders with those allied to Kenya Kwanza expressing their disappointment and the Azimio team in support of the move.
According to Justice Kanyi Kimondo and Ali Visram in a judgment issued on Monday, the law was not complied with in the establishment of the office of the chief administrative secretaries.
The three judge-bench further explained that it was not the intention of the framers of the constitution to have 50 CASs deputize 22 Cabinet Secretaries.
The judges added that there was no public participation during the exercise of creating the 27 posts.
Nandi Senator Samson Cherargei while speaking Tuesday argued that the move by the court was against an earlier decision by the courts that 23 CASs could be appointed.
The Nandi senator says such rulings will kill public confidence in the country's judicial process.
Former Kisii Deputy Governor Joash Maangi was among the CASs appointees who took their disappointment to social media describing the ruling as the most bizarre judgment he had ever seen.
Also shortly after the ruling, Azimio leaders who were at a public rally at Asango in the Ugunja constituency led by the national assembly minority leader Opiyo Wandayi said the decision by the court was worth celebrating.
The CASs, through their lawyers, sought a 90-day stay of Monday's ruling, arguing that they had already been sworn in and stopping them from conducting their duties would deny them an opportunity to appeal the verdict.
