The High Court has upheld the removal of former IEBC commissioner Irene Masit from office, affirming that the tribunal chaired by Justice Aggrey Muchelule acted lawfully and within its mandate.
The court ruled that the tribunal, established under Article 251 of the Constitution, followed proper legal procedures in handling the petition against Masit and could not be faulted for setting its own rules of engagement during hearings, provided fairness was maintained.
Masit had challenged the process, arguing that the tribunal relied on irregular procedures that compromised the fairness of the proceedings. However, the court dismissed the claim, stating that tribunals are permitted to regulate their own procedure as long as constitutional standards of justice are observed.
The case arose from petitions filed in the aftermath of the 2022 General Election, which triggered investigations into allegations of misconduct involving some IEBC commissioners over their handling of the presidential results.
The tribunal found that Masit participated in conduct that undermined public confidence in the electoral process, including her association with the rejection of the presidential election outcome announced by the IEBC chairperson.
It also examined claims that she was involved in discussions and actions that could have influenced or altered the final tallying process, allegations she denied throughout the proceedings.
In February 2023, the tribunal recommended her removal from office after concluding that the charges of gross misconduct had been proven to the required legal threshold.
The recommendation was subsequently implemented, leading to her formal dismissal from the electoral commission in line with constitutional provisions governing independent office holders.
In its judgment, the High Court emphasized that its role was limited to reviewing the legality of the process rather than re-evaluating evidence already considered by the tribunal.
The ruling brings to a close Masit’s legal challenge, effectively affirming both the tribunal’s findings and the decision to remove her from office.
