Court Denies Pastor Burale’s Bid to Pull Down Ex-Wife’s Controversial YouTube Interview

A Nairobi court has dealt a setback to Pastor Robert Burale by refusing his application to compel the removal of a widely viewed interview given by his ex-wife, Rozina Mwakideu, from the internet.
The interview, titled “My Biggest Mistake Was Marrying Robert Burale,” was posted on the YouTube channel of Rozina’s brother, Alex Mwakideu, on October 4th.
Burale had sued both Rozina and Alex, alleging defamation and seeking Ksh. 20 million in damages.
While Milimani Commercial Chief Magistrate Thomas Nzyoki declined the order to pull down the existing content, he issued an interim injunction on Tuesday, prohibiting both Rozina and Alex from further publishing or sharing the disputed interview on any social media platform until the case is fully heard and decided.
"An order for interim injunction is granted to stay the defendants (Alex and Rozina Mwakideu) from any further publication of the complained video on any social media platform pending the hearing and determination of the application,” Magistrate Nzyoki stated.
The Magistrate explicitly clarified that this order only blocks future distribution and does not require the deletion of the content already online.
