ODM To Rely On Video Evidence In Sifuna Removal Dispute

The Orange Democratic Movement has told the Political Parties Disputes Tribunal it will rely on video recordings and official transcripts to defend its decision to remove Edwin Sifuna as the party’s secretary-general.

In documents filed before the tribunal, ODM argues that the recordings will demonstrate repeated instances where Sifuna allegedly contradicted official party positions during public engagements and media appearances.

The dispute stems from a resolution passed by the party’s National Executive Committee in February 2026, which resolved to remove Sifuna from the powerful administrative post.

ODM maintains that the decision was lawful and anchored in the party constitution, citing concerns over what it describes as conduct inconsistent with collective resolutions.

The party further claims that Sifuna made public statements that diverged from agreed policy positions, creating confusion about ODM’s official stance on key political matters.

In response, Sifuna moved to the tribunal seeking to overturn the decision, arguing that the removal process was unconstitutional and that he was not accorded a fair hearing.

He contends that due process was not followed and that the National Executive Committee acted without giving him adequate opportunity to respond to the allegations.

The tribunal has since issued conservatory orders suspending the implementation of the removal, effectively allowing Sifuna to remain in office pending determination of the case.

Those orders also bar the party from effecting formal changes to its leadership structure until the matter is heard and determined.

ODM has raised a preliminary objection challenging the tribunal’s jurisdiction, arguing that Sifuna failed to exhaust internal dispute resolution mechanisms before filing the case.

The party insists that its internal structures provide clear procedures for addressing grievances and that external intervention was premature.

Legal teams representing both sides are expected to file detailed written submissions ahead of the scheduled hearing date set for mid-March 2026.

The case has exposed underlying tensions within ODM’s top leadership, with senior figures defending the NEC’s authority while allies of Sifuna call for transparency and adherence to procedural safeguards.

The tribunal’s ruling is expected to determine not only Sifuna’s political future within ODM but also clarify the extent to which internal party decisions can be challenged before statutory dispute bodies.
