MPs Reject Supreme Court’s Decision On LGBTQ

Members of the National Assembly have slammed the Supreme Court for giving a nod to the registration of lesbian, gay, bisexual, transgender, intersex, queer/questioning, (LGBTQ) associations saying it would taint the moral fabric of the nation.

The legislators join other groups including religious leaders, who termed the move as being ungodly, immoral, and against the African culture.

On Friday, the Supreme Court said that the decision to deny LGBTQ members their right to register as a Non-Governmental Organization (NGO), despite homosexuality being illegal in the nation, discriminatory. 

This followed a ruling made in 2013 by lower courts to deny members of the community in Kenya to register a Non-Governmental Organization for the advancement of their rights.

The leaders from both coalitions during a heated debate, spoke out against the decision, accusing the Western nations of attempting to destroy Kenyan culture.

The legislators now want the bench to review its decision saying the judgment went against the cultural norm and risks tainting future generations.

“I take courage in the fact that only three judges of the Supreme Court decided so two dissented and two were not there, we will go back with the religious institutions and we will request the Supreme Court in its full bench of seven to review the decision,” said Homa Bay Town MP Peter Kaluma.

Some advocated for the death penalty for LGBTQ offenses, claiming that it was worse than murder for Africans.

“They should have their capital punishment, this thing is worse than murder for us Africans.”
