Medics’ unions, including the Kenya Medical Practitioners, Pharmacists and Dentists Union (KMPDU), have announced plans to move to court on Monday to challenge orders stopping the implementation of the Sh322 billion Kenya–United States health cooperation deal. The unions say the suspension threatens critical healthcare programmes and could negatively affect service delivery across the country.

The planned legal action follows conservatory orders issued by the High Court halting the rollout of the agreement pending the determination of petitions challenging its legality. The petitions, filed by civil society groups and activists, raise concerns over public participation, parliamentary oversight and the handling of sensitive health data under the deal.

Union leaders argue that freezing the agreement will deny patients access to essential services and funding meant to strengthen the health sector. They maintain that the deal is vital for improving healthcare infrastructure, workforce support and disease response programmes, warning that prolonged delays could cost lives.

On data protection, the unions have assured Kenyans that adequate safeguards are already in place. They point to existing laws, including the Data Protection Act and the Digital Health Act, which they say provide clear frameworks to prevent misuse or unlawful sharing of personal health information.

The unions say they will seek urgent court intervention to lift or vary the orders stopping implementation of the deal. At the same time, they have called for dialogue among all stakeholders to address concerns raised, insisting that healthcare delivery and patient welfare should remain the top priority as the legal process unfolds.
