The High Court in Nairobi has dismissed an application by the United Democratic Alliance seeking to suspend enforcement of a tribunal decision that nullified the expulsion of former nominated Senator Gloria Orwoba.

The court declined to grant a stay of execution pending appeal, ruling that the party’s Electoral Nomination and Dispute Resolution Committee failed to meet the legal threshold required for such orders.

Justice L.P. Kassan held that the applicant did not demonstrate “substantial loss,” a key requirement in applications seeking to halt enforcement of a judgment.

The dispute traces back to May 2025, when UDA’s disciplinary committee expelled Orwoba from the party over alleged misconduct.

However, the Political Parties Disputes Tribunal later overturned that decision, finding the expulsion unlawful and procedurally flawed, citing lack of a fair hearing and due process.

Following that ruling, UDA moved to the High Court seeking to suspend its enforcement, arguing that failure to do so could expose it to contempt proceedings and interfere with its internal disciplinary autonomy.

Orwoba opposed the application, terming it frivolous and an abuse of court process, insisting that the tribunal had only quashed the expulsion without issuing enforceable positive orders.

In its determination, the court also rejected claims that the party risked contempt, noting that the tribunal’s directives were addressed to the party itself and not the committee that filed the application.

The judge further observed that the tribunal’s decision did not prevent UDA from exercising its disciplinary mandate, provided it acts within the law.

The court concluded that even if the appeal succeeds, it would not be rendered meaningless, dismissing fears raised by the applicant.

Ultimately, the application was dismissed for lack of merit, with the court directing each party to bear its own costs, citing the political nature of the dispute.
